The City of Peterborough has withdrawn its Notice of Intention to Designate 1400 Monaghan Road, known as The Martin House, under the Ontario Heritage Act (OHA) after receiving an objection from the property owner.
City Council initially passed the motion to issue the notice on September 23rd, citing the property’s cultural heritage value. The notice, published on October 1st, opened a 30-day window for objections. Representatives for the property owner submitted an objection during that period, prompting Council to review its position as required under changes to the OHA introduced in 2022 through Bill 23.
Previously, objections to such notices were automatically sent to the Ontario Land Tribunal (OLT). Now, Council must first evaluate the objection and decide whether to proceed with or withdraw the designation notice.
Council’s decision to withdraw means the property is removed from the City’s Heritage Register. If Council had chosen to proceed, the designation would have triggered an additional 30-day objection period, during which appeals could be made to the OLT.
The City will inform the property owner of its decision and publish notice of the withdrawal.
